THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This notice applies to protected health information ("PHI") held by True Health Wellness and Dr. Ilana Goldberg, DC ("we", "us") when you are a patient. It is provided under the federal Health Insurance Portability and Accountability Act (HIPAA). It is separate from our website Privacy Policy, which covers information collected through this website.
Our responsibilities
- We are required by law to maintain the privacy and security of your PHI.
- We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
- We must follow the duties and privacy practices described in this notice and give you a copy of it.
- We will not use or share your information other than as described here unless you tell us we can in writing. You may change your mind at any time by telling us in writing.
How we may use and disclose your health information
We may use and share your PHI without your written authorization in these ways:
- Treatment. To provide, coordinate or manage your care, including with other health care providers involved in your care, and to order and review laboratory tests.
- Payment. To bill for services and receive payment, including from you, your insurer or another payer.
- Health care operations. To run our practice, improve the quality of care, train staff, and contact you with appointment reminders.
- As required by law. When federal, state or local law requires disclosure.
- Public health and safety. To report certain diseases, injuries or adverse events, to report suspected abuse or neglect, or to prevent a serious threat to health or safety.
- Health oversight, legal and law enforcement. To health oversight agencies, in response to a court order, subpoena or other lawful process, and to law enforcement as permitted by law.
- Workers' compensation, coroners and funeral directors, and specialized government functions, as permitted by law.
- Business associates. To vendors that perform services for us (such as scheduling, billing or secure messaging) and that have agreed in writing to protect your information.
Uses that require your written authorization
We will get your written authorization before using or sharing your PHI for the following purposes:
- Marketing, except for face-to-face communication or a promotional gift of nominal value.
- Any sale of your PHI.
- Most uses and disclosures of psychotherapy notes, if we maintain any.
- Any other use or disclosure not described in this notice.
Your rights
- Access. You can ask to see or get a copy of your health and billing records, usually within 30 days. We may charge a reasonable, cost-based fee.
- Amendment. You can ask us to correct information you believe is incorrect or incomplete. We may decline, and will tell you why in writing.
- Confidential communications. You can ask us to contact you in a specific way (for example, by mobile phone rather than home phone) or at a different address. We will say yes to reasonable requests.
- Restrictions. You can ask us not to use or share certain PHI for treatment, payment or operations. We are not required to agree, except that if you pay for a service out of pocket in full and ask us not to share that information with your health insurer, we will say yes unless the law requires us to share it.
- Accounting of disclosures. You can ask for a list of the times we have shared your PHI in the six years before your request, who we shared it with, and why. It excludes disclosures for treatment, payment, operations and certain others.
- A paper copy of this notice. You can ask for a paper copy at any time, even if you agreed to receive it electronically.
- Choose someone to act for you. If you have given someone medical power of attorney, or if someone is your legal guardian, that person can exercise your rights. We will verify their authority before acting.
- File a complaint. See below. We will not retaliate against you for filing one.
